Israel adopts international principles for innovation and responsible use of artificial intelligence

The Ministry of Innovation, Science and Technology and the Consulting and Legislation Department (Economic Law) at the Ministry of Justice publish a policy document on regulation and ethics in the field of artificial intelligence, which guides government ministries in their activities; A government knowledge center will be established for the benefit of the issue

Further to the government's decisions (212 of August 1.8.2021, 173 and 24.2.2023 of February XNUMX, XNUMX) and further toThe National Program for Artificial Intelligence, the Ministry of Innovation, Science and Technology and the Legislative Advisory Department (Economic Law) at the Ministry of Justice, publish a document regarding the regulatory policy and ethics in the field of artificial intelligence, which will guide government ministries and regulators to act according to these principles.

The document guides the regulators to act on several levels:

  • act at this stage within the framework of sectoral regulation and not within the framework of horizontal regulation;
  • act in accordance, as much as possible, with regulation in developed countries and international organizations;
  • Having a risk management procedure in relation to the development and use of technology and adjusting the regulation to the risk;
  • Use of advanced and flexible regulatory tools that will make it possible to extract the social and economic benefits from the technology while learning it - such as ethical principles, standardization, self-regulation, and modularity and experimentation;
  • The development of regulation while involving those with knowledge, experts and stakeholders (representatives of industry, academia, civil societies and the public as a whole) in order to produce a professional and technological infrastructure that will express a balance between the various rights and interests.

In addition, the document specifies ethical principles in the field that correspond to the OECD principles, according to which there will be room to act when developing, using and determining the regulation of artificial intelligence: responsible use of artificial intelligence in order to enable the encouragement of growth and sustainable development, social welfare and the promotion of Israel's leadership in the field of innovation;

  • Development of artificial intelligence in accordance with the law, fundamental rights and public interests and above all maintaining human dignity and privacy while maintaining equality and preventing discrimination;
  • Promoting transparency and explanatory in relation to the decisions and activity of artificial intelligence systems;
  • Developing reliable and safe artificial intelligence systems so that they operate without unreasonable safety risk;
  • Development, operation and use of artificial intelligence technology in a proper manner and in compliance with ethical principles.

In accordance with Government Resolution 173, the Ministry of Innovation, Science and Technology, in collaboration with the Consulting and Legislation Department (Economic Law) in the Ministry of Justice, will establish a governmental knowledge and coordination center in the fields of artificial intelligence. This center will provide answers to all matters related to regulation, information and data policy, ethical issues, civil international cooperation and assimilation in the public and civil sector. The activities of the knowledge center will be accompanied by a steering committee whose role is to recommend to the Minister of Innovation, Science and Technology a national strategy in the field of artificial intelligence and update it from time to time, to examine the need to change policy periodically, to advise regarding the knowledge center's annual work plan and to recommend goals.

In accordance with the proposed policy, each regulator will work to identify and map the uses of artificial intelligence systems by supervised entities and others in the field they are entrusted with; the challenges and risks involved; and the possible torturers. This is in accordance with the challenges detailed in the document of principles (discrimination; human involvement; explanatory; disclosure; reliability, durability, security and safety; responsibility; and privacy) and to implement the accepted ways of dealing.

Minister of Innovation, Science and Technology Ofir Akunis: "After completing a comprehensive and professional staff work, I decided to adopt the conclusions of the document concerning regulatory policy and ethics in the field of artificial intelligence in Israel. The revolutionary potential of technology is rapidly affecting the improvement of the quality of the citizens of the State of Israel: in medicine, science, technology, agriculture, education, security and more. However, along with the many benefits, there are also many risks - one must make sure that the person remains at the center of decision-making along with a set of ethical principles. These principles enable responsible and responsible development and use while ensuring the preservation of fundamental rights and public interests, human dignity and privacy, equality and prevention of discrimination and full transparency."

The minister also added: "Now, with the completion of the work on the policy document and its publication to the public, I intend to promote a government decision that will enable the adoption of the policy by the Israeli government, guide the regulators to act in accordance with it and enable the implementation of the said policy. This, in order to strengthen the position of the State of Israel as a technological leader and to enable the promotion of a policy of responsible innovation."

Encouraging innovation while integrating it responsibly in the various areas of life requires us to adapt the legal and regulatory tools to the reality where "human" actions will be performed by algorithms. We approach this task with the necessary caution and responsibility - on the one hand, yes, taking the initiative to ensure that the integration of artificial intelligence is done in a responsible manner and in accordance with the public interest, and on the other hand, an attempt to act gradually and in accordance with what is happening in the world so as not to create barriers that could prevent the Israeli public from innovative services and products or limit the industry in Israel. The report and its recommendations constitute a significant milestone in Israel's progress in the field of artificial intelligence - it serves to provide certainty and give direction for the continued work required in the field - both on a practical level in relation to the manner in which the field is organized and in relation to the future work required in the field.
